Temporary Humanitarian Concern Visa (Subclass) 786

Subclass 786 visa is structured to allow applicants to stay in Australia for reasons of Humanitarian Concern. In order to be eligible to apply for this visa, an applicant should be the holder of a class UJ, Temporary Safe Haven visa. As of 2014, applicants who sought asylum and requested protection were refused a visa due to the introduction of clause 866.222 (introduced in 2013) in the Migration Regulations 1994 (Cth). The DIBP discussed a resolution for those asylum seekers and offered a subclass 449 Humanitarian Stay (Temporary) visa and subsequently a Temporary Humanitarian Concern (Subclass 786) visa to them. An applicant can only apply for a Humanitarian Concern visa if they have been invited to apply for it and have been interviewed by the authorized officer.

How Does a Temporary Humanitarian Concern Visa (Subclass) 786 Work

A holder of a subclass 449 visa will be invited to apply for a subclass 786 Temporary Humanitarian Concern visa if the Minister is satisfied that, for reasons of humanitarian concern, the candidate should be permitted to remain in Australia for a further period. Subclass 786 visa is a temporary permit to the country. This visa allows its holder to-

  • Live in the community.
  • Reside on this visa in Australia for up to 3 years (the exact length or duration of the visa is determined by the Minister).
  • Work in the country in their respective field of interest.
  • To enroll in the health care scheme of the Government.
  • If they don’t have income can access Centrelink payments 3.

Visa holders who have been granted the subclass 786, Temporary Humanitarian Concern visa can not re-enter Australia on this visa once they depart. This visa does not have provisions to sponsor family members to Australia.

A Temporary Humanitarian Concern visa is usually valid for three years, but the validity duration can be varied at the discretion of the Minister. A subclass 786 visa holder is required to leave Australia once the validity of the visa expires and can not apply for another visa (e.g., partner visa, skilled visa) while in Australia unless the Minister offers another visa.

  • The applicant must not be a person whose presence in Australia might be detrimental to the interest of Australia’s Foreign Policy.
  • The Department must be convinced that the applicant is not associated with any proliferation of mass destruction weapons.
  • To ensure a favorable visa decision, the Department must be convinced based on the evidence so provided that the visa grant is in the candidate’s best interest.
  • The holder of a subclass 851 visa application must agree to abide by the laws of the country.
