  • The applicant must be the holder of any of the –
    • Business Owner (Provisional) visa (subclass 160)
    • Senior Executive (Provisional) visa (subclass 161)

    • State/Territory Sponsored Business Owner (Provisional) visa (subclass 163)
    • State/Territory Sponsored Senior Executive (Provisional) visa (subclass 164)
    • State/Territory Sponsored Investor (Provisional) visa (subclass 165)
  • The applicant must have satisfied all the conditions of the primary existing visa.
  • The applicant must be in Australia for the past one year in the past two years from filing the visa application form.
  • The applicant must have an ownership interest in the past two years (from the date of filing of the visa application form) in at least one of Australia’s active businesses. The combined ownership interest of the applicant along with their partner must be at least-
    • 51% of a business with a turnover of less than AUD400,000 per year, or
    • 30% of a business with a turnover of AUD400,000 or more per year, or
    • 10% of a publicly listed company.
  • The applicant must provide documentary evidence that each main business of the applicant satisfies the conditions to be assessed as a qualifying business as per the 892 visa requirements.
  • Each main business of the applicant should have a distinct Australian Business Number (ABN).
  • The applicants along with their partner combinedly must hold for the past one year (from the date of filing of the visa application form) at least-
    • net business assets in the main businesses of AUD 75,000,
    • net business and personal support in Australia was AUD250,000,
  • The applicant must have employed one or more individuals, equivalent to one full-time employee. The employee must be an Australian citizen or permanent resident or an eligible New Zealand citizen.
  • The annual turnover of the leading business or two main businesses of the applicant must be at least AUD200,000 for the past one year (from the date of filing of the visa application form).
  • The applicant must be sponsored by the regional authority in the state or territory.
  • The applicant must meet all the health and character requirements of the visa category.
  • The applicant and the family unit members (named in the application) must have paid back or made necessary arrangements to pay back all the money due to the Government of the country.
  • The applicant must not have a history of canceled visas as it might lead to rejection of the visa application.
