Remaining Relative Visa (Subclass) 115

The subclass 115 visa is designed for those individuals who live outside the country and wish to stay permanently with their only near relatives in Australia.

If an applicant’s only near relative is: an Australian citizen or permanent resident or an eligible New Zealand citizen, usually residing in Australia, they qualify to apply for a remaining relative (subclass 115) visa in Australia. This is an offshore visa process. While Subclass 835 is an onshore visa.

What is the Eligibility for Subclass Visa 115

  • As per the eligibility norms, the candidate must be sponsored by their only near relatives (i.e-their eligible parent/step-parent, sibling/step-sibling, or partner).   • The candidate and their sponsor must have paid back all the dues to the Australian Government (if there is any) or have made adequate payment arrangements.
  • The applicant must sign a values statement to confirm they will obey the Australian laws and living rules.
  • The candidate must meet the health and character requirements as set by the 115 visa conditions.
  • The applicant must not have a history of cancelled visas as it might lead to rejection of the visa application form.
  • An applicant must not arrive in Australia before the person specified in visa (i.e- the sponsors need to be in Australia before the applicant makes an entry)
  • An applicant must not marry or enter into a de facto relationship before entering Australia on this visa.

As per the 115 Visa conditions, the following relatives are defined as near relatives-

  • Parent or step-parent
  • Partner’s parent or step-parent
  • Sibling or step-sibling
  • The child who is 18 or older and not dependent on you (or step-child)
  • Child or step-child who is under 18 and not in your daily care and control (or your partner’s)

The Department does not consider the extent of association between you and your near relatives when they decide. Further, the Department must be convinced that the visa grant is in the applicant’s best interest to make a favourable decision on the visa application form.
