New Legislative Updates for Multiple Visas

Australia has made new regulations and changes that will impact various visa categories. The key updates include: 

TSMIT Increase 

The Temporary Skilled Migration Income Threshold (TSMIT) has risen from $70,000 to $73,150. This modification reflects a 4.5% increase in the Average Weekly Ordinary Times Earnings figure from November 2023. The recent TSMIT relates to nomination applications lodged on/after 1 July 2024. Any Labour Market Testing (LMT) evidence provided for subclass 482 or 494 nominations must now correspond with this revised salary threshold.  

Workplace Justice Visa Pilot 

The latest Workplace Justice visa (WJV) is executed via Migration Amendment Regulations. It allows the migrants to stay in Australia to address workplace exploitation. Also, this visa is a part of Subclass 408 (Temporary Activity Visa) that will be on trial for 6 to 12 months.  

Moreover, the visa is only available to those who have required government certifications or recognized non-government organization. Furthermore, the family members of the WJV holders can also apply for this visa without any application charges.  

Strengthening Reporting Protections 

The migration regulations “Strengthening Reporting Protections” are made to enhance protection for migrant workers who report exploitation. The new rules outline “non-discretionary” and “discretionary” protections against visa cancellation for workers affected by exploitation. However, specific conditions must be fulfilled including certification and written commitments to comply with visa conditions.  

Daily Maintenance Amount for Detained Persons 

The Migration (Daily Maintenance Amount for Persons in Detention) Determination (LIN 24/017) 2024 sets the daily maintenance allowance at $538.79 for the period from 1 July 2024 to 30 June 2026. This amount applies to all persons in detention during this period.
