Family Visa-Parent

Family visas in Australia have been designed to provide a pathway for family members to sponsor their parents, children, spouse, or partner to be with them in Australia. It is for those individuals who are citizens or permanent residents in the country (or an eligible New Zealand citizen) to sponsor their family to come to the country and settle with them under the family visa stream. If one has his family (spouse, or partner, or children, or parents) in Australia, they could sponsor their permanent or temporary residence in the country by using any of the eligible family visa streams.

Parent visa is one such stream under the family visas, which is used when one’s children are Australian citizens, permanent residents, or eligible New Zealand citizens. Your children or their eligible partners can sponsor your parent’s visa to Australia. Under this stream, the definition of a parent includes-

  • Biological Parent
  • Legal Parent
  • Adoptive Parent
  • Step-Parent Or
  • Parent-In-Law

The basic requirements to be eligible for a Parent visa can be summed up as under:

  • The applicant must be a Parent of a citizen or a permanent resident.
  • The sponsoring child who is an Australian citizen or permanent resident must have spent at least two years living in Australia.
  • The applicant must pass the Balance of Family Test.
    (i.e., at least one-half of the applicants’ children and step-children must be citizens or permanent residents of Australia, or the majority of the applicants’ children must be settled as permanent citizens or residents of Australia than any other single country).
  • Applications for both the non-contributory and contributory parent visas, which have been lodged onshore, require the main applicant to be at least 66 years of age or older.
  • Assurance of Support (AoS)- Applications for a permanent Parent category visa require an AoS by their sponsoring child.

For migration to Australia, both temporary and permanent options have been designed for the parents of eligible Australian citizens and permanent residents. Currently, there are many classes of Parent visas that fall into the major categories non-contributory and contributory. The visas may also be classified on the basis of other stipulations and conditions, such as temporary and permanent residence, an applicant’s age, sponsorship, and support by an eligible child.

To secure a permanent residency for parents: ‘non-contributory’ and ‘contributory’ are the major two pathways. The non-contributory visa does not require a significant monetary charge but has a very long processing time. On the other hand, the contributory parent visa gets processed a lot sooner but has a significant monetary charge attached to it.

Parent visa in Australia is further categorized into the following –

Subclass 103 Parent Visa

Subclass 103 is a popular visa category for a Parent Visa. This category allows an individual to apply for a permanent Australian visa if their child/step-child is a settled Australian Citizen, Australian Permanent Resident, or eligible New Zealand Citizen. The candidate for this category must be sponsored by their eligible children or partner of the children. The candidate must agree in writing to abide by and respect Australian laws. The candidate for the subclass 103 visa category must be outside the country when the decision on their visa application form is made by the Department. The applicant is also authorized to name their aged partner or dependent family members in their application. However, certain requirements as fixed by the Department, need to be met for the approval of the dependent individual’s immigration processing. This visa is appropriate for those parents who intend to migrate and live in Australia for an indefinite period with their children. However, the parents should pass the balance of family test.

Subclass 143 Contributory Parent Visa

Subclass 143 is systematically called a Contributory Parent Visa. It is a parent visa that lets the applicant, who has children living in Australia as permanent residents or citizens or eligible New Zealand citizens residing in the country for a minimum of 2 years, to live and settle in Australia permanently. An eligible child or partner of the child should sponsor the applicant. The applicant makes a considerable amount of payment towards this visa in the form of a contribution that offsets the rights that come with this visa, like health care and other facilities granted by the Government. The huge contribution is to compensate for some of the rights that are at par with the rights of Australian Citizens/Residents. This is why the category is referred to as “contributory” This visa marks the second stage for processing of contributory parent visa in Australia.

Subclass 173 Contributory Parent (Temporary) Visa

Subclass 173 Contributory Parent visa facilitates the parents of the eligible individuals to stay in the country temporarily. However, there is no facility to renew or extend the subclass 173 visa. Subclass 173 lets the applicant live in Australia for up to two years.

An applicant is required to pay a significant charge for this visa as compared to a normal parent visa because, under this subclass, the waiting time is reduced significantly due to the payment of a hefty application fee in the form of a contribution.

An applicant arriving in Australia under subclass 173 can plan to apply for a subclass 143 Contributory Parent visa. This way, the high cost of the Contributory Parent migration visa can be spread over a number of years.

Subclass 804 Aged Parent Visa

Subclass 804 is structured for those eligible parents of Australian citizens, permanent residents, or New Zealand citizens (if eligible) who wish to stay in the country permanently. The applicant must be of the age to enrol for pension in the country. Subclass 804 visa has the lowest application fee of all the Parent visas. The processing of subclass 804 visa is a long drawn affair, usually takes up to 13 years to be approved. If an application is made in Australia, the applicant may be able to remain in Australia on a bridging visa during the processing of the visa.

Subclass 864 Contributory Aged Parent Visa

The subclass 864 contributory aged parent visa is framed for eligible children to sponsor their retired parents to stay permanently in Australia. The applicant must be of the age to enrol for pension in the country. Subclass 864 visa is meticulously structured for individuals who can afford an enormous “Contribution” of money to offset the rights and privileges awarded to the permanent visa holders. It is a way to compensate for the part that they have not contributed to throughout their lives as ordinary residents have by way of tax.
