How does a Subclass 808 Confirmatory Residence Visa Work

The subclass 808 belongs to the Class AK category of the Australian visas; this visa was structured to accommodate the integration of Norfolk Island into the Australian migration zone since the Immigration Act 1980 (NI) ceased to apply from 1 July 2016. Consequent to the integration, all non-citizens on Norfolk Island were required to hold a visa under the Migration Act 1958. The system transitions residents of Norfolk Island and certain permit holders, along with newborn babies of certain permit holders, to the visa system under the Migration Act 1958 (Cth) on 1 July 2016. The confirmatory residence visa has been designed accordingly for the former holders of Norfolk Island entry permits. This is a permanent visa that lets eligible residents from Norfolk Island live and work freely in Australia. An 808 visa holder can travel overseas and return to Australia as a permanent resident until the travel component of their visa expires.

What are the Eligibility Requirements for a Confirmatory Residence Visa Subclass 808

To apply for a subclass 808 visa, an applicant needs to ensure that they comply with all the eligibility requirements for the visa category.

  • The applicant might apply for this visa if, on 30 June 2016, either of the following conditions applied to them
    • The applicant held a temporary entry permit (TEP), a general entry permit (GEP), or an unrestricted entry permit (UEP) under the former Norfolk Island Immigration Act 1980 (now repealed), or
    • The applicant didn’t hold a TEP, GEP, or UEP, but held a UEP prior to 30 June 2016 and was ordinarily resident in Norfolk Island at that time.
  • A dependent child of a former holder of a TEP, GEP, or UEP might also be eligible to apply for the visa if:
    • The child was born outside Norfolk Island on or before 30 June 2016 and did not hold a TEP, GEP, or UEP, and
    • On 30 June 2016, the prospective applicant was a dependent child of:
      • A parent (excluding an adoptive parent) who held a TEP, GEP, or UEP on 30 June 2016 (or a dependent child of this person), or
      • A parent who did not hold a TEP, GEP, or UEP on 30 June 2016, but held a UEP prior to 30 June 2016 and were ordinarily resident in Norfolk Island at that time (or a dependent child of this person).
  • An applicant is required to be lawfully present and residing in Norfolk Island or elsewhere in Australia for a period of five out of the seven years at least immediately before applying for a subclass 808 visa.
  • An applicant might still be eligible to apply for the visa if they don’t meet the requirement and have been living somewhere else in Australia to study and, during that time:
    • If they are the dependent child of a person who lives in Norfolk Island
    • If they haven’t turned 25
    • If they meet or have met the requirements of condition 8105, which is a work limitation for students.
  • An applicant must ensure that they, along with accompanying secondary applicants, meet the health and character requirements as et out by the Department.
