Subclass 890 visa in Australia is better known as a business owner visa. This visa category is structured for those eligible business owners or entrepreneurs who wish to permanently continue their activity in the Country. This is a second stage visa. What Are the Eligibility Requirements for a Business Owner Visa 890

To be eligible to apply for a subclass 890 visa, the applicant must meet the Department’s required eligibility conditions:

  • The candidate must be a holder of an eligible visa, which may be –
    • Subclass 160- Business Owner (Provisional) visa
    • Subclass 161- Senior Executive (Provisional) visa
    • Subclass 162- Investor (Provisional) visa
    • Subclass 163- State/Territory Sponsored Business Owner (Provisional) visa
    • Subclass 164- State/Territory Sponsored Senior Executive (Provisional) visa
    • Subclass 165- State/Territory Sponsored Investor (Provisional) visa
  • The applicant must have lived in Australia as a holder of an eligible visa for at least one year in the past (immediate) two years before the application is made. The one year stay period is not required o be continuous.
  • The applicant must show their ownership interest in one or more businesses in Australia (actively operating) for at least the past two years from the date of filing of application form under subclass 890.
  • The combined ownership, as well as day to day management interest of the candidate and their partner (spouse/de-facto partner) for the previous two years, must be –
    • 51% of a business (where turnover is less than AUD400,000 per annum), or
    • 30% of a business (where turnover is AUD400,000 or more per annum), or
    • 10% of a publicly listed company
  • The applicant (along with their partner) must show documentary evidence for the last one year from the date of filing of the application form of having –
    • The combined net business assets of at least AUD100,000 in their main business
    • Annual turnover of at least AUD300,000 in their primary industry (or two main businesses together)
    • Two full-time employees or the equivalent of two full-time employees. (Employees must be permanent residents, Australian citizens, or eligible New Zealand passport holders. Members of the family unit cannot be included)
    • The combined net value of the business and personal assets in Australia of at least AUD250,000.
  • The candidate must have fulfilled all the pre-requirements of the original visa category (temporary).
  • The applicant and the members of their family unit must pay back or make arrangements to pay back all the dues that they owe to the Government of the country.
  • The candidate must meet all the health and character requirements of the visa category.
  • The candidate must agree to abide by and respect Australian laws.
